Exclusive – Kobach: It Appears That Out-of-State Voters Changed the Outcome of the New Hampshire US Senate Race

In November, President Donald Trump claimed "serious voter fraud" in New Hampshire.

"Making this equation that somehow people not updating their driver's license is an indicator of voter fraud would be nearly as absurd as saying that if you have cash in your wallet, that that's proof that you robbed a bank", Maine Secretary of State Matt Dunlap said to applause.

It's not primary season, but voting is top of mind in New Hampshire these days. The panel heard from several witnesses who have conducted studies that they say show numerous cases of people voting a few times, or noncitizens casting ballots illegally.

The president's claims, and his appointed commission, have been widely and repeatedly criticized by many political analysts and experts in the United States - not all of them Democrats.

He said hackers have myriad ways of attacking voting machines.

Gardner said people could live in New Hampshire, such as college students, and vote legally with an out-of-state license.

But the commission heard from several witnesses Tuesday that it's not always easy to find those facts, that voter data are limited and often incomplete, and that it's hard to know what accounts for the drop in participation in USA elections since the 1960s. But a Gallup poll back in 2004 found the same percentage of Americans-25 percent-feared illegal voting "would be a major problem in the election". But New Hampshire's law is somewhat complicated because the Granite State makes a distinction between being a "resident" of the state and being "domiciled" in the state. In fact, a 2015 court ruling decided that very question in New Hampshire, finding that you can be eligible to vote in New Hampshire but not be subject to the driver's license residency regulation. Such misleading allegations typify the voter-fraud campaign, because it's really a cure for which there is no disease. He cited the fact that thousands of New Hampshire voters used out-of-state licenses as ID past year and have yet to update those licenses. So if Kobach wants to find what's undermining voters' confidence in voting, he need only look in a mirror. It is a role based entirely on citizens freely exercising our most fundamental right - the right to vote.

Despite all of this, The Washington Post's Monkey Cage blog found no unusual turnout surges in 2016 that might be explained by buses from MA, and Former New Hampshire GOP chair Fergus Cullen dismissed the claim, calling it as old as buses themselves in an interview with USA Today.

The charge was leveled Thursday by Kris Kobach, the Republican secretary of state in Kansas, the commission's vice chairman and, most recently, columnist for the website Breitbart News.

He said the system has most of the information registrars are interested in - chiefly citizenship status and criminal history - when they sign up voters.

Former Gov. John H. Sununu offered opening remarks as an invited guest, and echoed Gardner's concern that voters must be convinced that the election process has integrity in order to encourage their participation.
